Product liability shall rest with the Manufacturer solely in any event. 1.2 Feline Infectious Peritonitis involves complicated pathophysiolgical mechanisms, the use of 441mmm’s product does not guarantee recovery, in the case of death and/or major complications, under no circumstances shall 441mmm be liable for any claim, loss, damage or compensation in whatever nature howsoever arisen in connection with the Product and Services of 441mmm. 1.3 441mmm will provide technical support and customer services. 441mmm does not warrant the quality or availability of any of the Services either in whole or in part provided to the Customer and 441mmm is not responsible and liable for any loss, damage, claim or expense suffered by the Customer caused by any delay, suspension, failure, mistakes or cancellation of any or all of the Services . 1.4 In the event that any provision of the Service is contracted out or assigned to 441mmm’s agents, 441mmm disclaims any consequence, responsibility or liability arising from the acts, default, negligence, mistakes of 441mmm's agents. 1.5 With respect to the information released from the third party to the Customer via 441mmm’s Services, 441mmm does not warrant its accuracy, quality, usefulness or completeness and will not accept any responsibilities for any loss or damage whatsoever suffered by the Customer as a result of the use or access to the relevant information. 2. General 2.1 441mmm retains the right, to be exercised in its absolute discretion and without assigning any reason, to accept or reject any Product and Services offered by 441mmm. 2.2 In the case of the Customer being a corporation or a limited company, the Customer warrants that the persons executing the Agreement and incidental documents have express authority to do so on its behalf. 2.3 The Agreement shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region. 2.4 441mmm reserves the right to vary, delete or amend any of the terms and conditions herein contained from time to time provided prior thirty (30) days’ written notice has been given to the Customer (for such purpose, the posting of the amendments, variation and/or deletion on the website of 441mmm shall suffice as written notice to the Customer) to that effect. 2.5 Any dispute arising out of the Terms & Conditions shall be first resolved by discussions in good faith. No legal proceedings shall be instituted by the Customer in the absence of good faith discussion in pursuance of this clause. 2.6 Unless otherwise stated, any notice to be given by 441mmm to the Customer may be either personally delivered to the Customer or by SMS to any of the Customer’s registered numbers, or by ordinary post, facsimile or email to the registered address or any address as notified by the Customer. Such notice shall be deemed to have been received by the Customer twenty-four (24) hours after dispatch if by postal service or personally delivered, or deemed to have been received by the Customer immediately after dispatch if transmitted by SMS, facsimile or email. 2.7 In case of any dispute, the decision of 441mmm should be absolute and final. 2.8 Neither 441mmm nor the Customer intends any terms of these terms and conditions of this Agreement to be enforceable pursuant to the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the laws of Hong Kong). 2.9 If there is any discrepancy between the Chinese and English versions of the Agreement, the English version shall prevail. (ii) I have read, understand and agree to the provisions in the General Personal Information Collection Statement and Privacy Policy Statement. (iii) I hereby declare that I (a) am the holder of the credit card, debit card, or third-party payment platform account used for this transaction; or (b) have obtained the consent of the holder of the credit card, debit card, or third-party payment platform account to use their card or account to pay the amounts due for this transaction, and to use the relevant card or account information for identity verification purposes when collecting the goods.
